These Terms of Service (“Terms”) govern your use of the Ape Born mobile app and related services (the “Service”) provided by Ape Born (“we”, “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 13 years old (or the minimum age required in your region) to use the Service. By using it, you confirm you meet this requirement.
You can create an account with an email and password, or with Sign in with Apple or Google. You are responsible for keeping your credentials secure and for activity under your account. You can delete your account and associated data at any time from within the app (Settings).
Ape Born lets you pair and control an Ape Born EMS (electrical muscle stimulation) training device, run guided sessions, and track your workout history. A compatible Ape Born device is required to control a live session. We may update, change, or discontinue features over time.
EMS training carries inherent risks. The Service is for general fitness use and does not provide medical advice. Consult a physician before use. Do not use the Service or an Ape Born device if you have a pacemaker or other implanted electronic device, a heart condition, or epilepsy, or if you are pregnant. Stop immediately if you feel pain, dizziness, or discomfort. You use the Service and any connected device at your own risk, and you are responsible for exercising within your own physical limits.
You agree not to misuse the Service — including attempting to disrupt it, access it without authorization, reverse-engineer it except as permitted by law, or use it in violation of any applicable law.
The Service, including its software, content, and trademarks, is owned by us or our licensors. We grant you a limited, personal, non-transferable license to use the app for its intended purpose. You retain ownership of the workout data you generate.
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including fitness for a particular purpose. We do not warrant that the Service will be uninterrupted, error-free, or that it provides any specific fitness or health outcome.
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, or consequential damages, or for any injury arising from your use of the Service or an Ape Born device. Our total liability for any claim relating to the Service is limited to the amount you paid us for it (if any) in the 12 months before the claim.
We may update these Terms; we will revise the “Last updated” date and, for material changes, notify you in the app. Continued use after changes means you accept the updated Terms.
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules.
